UAE Court Judgement Recognized and Enforced in China
“The Federal Court of Appeal for Fujairah of [the UAE] rendered its final judgment and entered into force. The [Chinese] court examined and confirmed that the judgment of the court of the United Arab Emirates did not violate the legal principles of the People’s Republic of China, nor did it endanger national sovereignty, security and social public interests. Therefore, the court recognized the validity of the judgment in question and enforced it. “ ((2018) Hu 01 Xie Wai Ren No. 15, (2018)沪01协外认15号
The Chinese court further reasoned:
“This case involves the recognition and enforcement of foreign court judgments in China. According to the provisions of the Civil Procedure Law, if a judgment or ruling of a foreign court becomes legally effective, it needs to be recognized and enforced by the people’s court of the People’s Republic of China. The parties may apply directly to the Intermediate People’s Court with jurisdiction, or may apply to the court for recognition and enforcement in accordance with the provisions of international treaties or the principle of reciprocity.
After review, the [Chinese] court finds that the judgment does not violate the basic principles of the laws of the People’s Republic of China, national sovereignty, security, social and public interests, etc., and recognizes its validity and enforces it.
The judgment in this case was rendered by the courts of the United Arab Emirates, which, in accordance with the agreement between China and the Arab Emirates, shall recognize and enforce the civil, commercial and status decisions of the other court of law in accordance with the laws of their respective countries. The applicant, [***], applied for recognition and enforcement of the judgment and submitted relevant evidence and documents. The respondent participated in the litigation proceedings, raised defenses and exercised litigation rights.”
