Biography

Fernando has over 30 years of experience in Dispute Resolution, Bankruptcy & Insolvency, Litigation, Arbitration, and Mediation. He has been admitted to practice in New York and before the federal courts of the U.S. Second Circuit since 1995.

He currently serves as a conciliator and trustee before the Federal Institute of Specialists in Commercial Insolvencies (IFECOM), bringing more than 17 years of experience in insolvency proceedings. He is also a certified mediator before the Superior Court of Justice of Mexico City.

Fernando has acted as counsel in more than 25 international commercial arbitrations and over four investment arbitrations. He is consistently recognized among Mexico’s leading attorneys in his practice areas by prominent international legal directories, including Chambers and Partners, The Legal 500, Leaders League and Best Lawyers.

Experience

 

  • Represented GEAR Alimentos and RUBE Alimentos, companies specialized in the production, packing and distribution of tomatoes for export to the U.S. market, in the negotiation process for the sale of their assets to Agrofibra, reaching a value of $20 million dollars.
  • Represented Olarena Hospitality Group in the negotiations with Mextenis to hold Los Cabos Open Tennis Tournament at Cabo Sports Complex.

Bankruptcy & Insolvency

  • Represented Landsteiner Scientific, one of Mexico’s largest and most important pharmaceutical companies, in obtaining a financing agreement.
  • Represented MTI Transport in its insolvency proceeding as well as in the individual proceedings that some creditors have begun against our client.
  • Appointed as conciliator within the insolvency proceedings of the companies Grupo Almos and Soluciones Integrales Almos. These companies were two of the main fish and seafood import and distribution companies nationwide.
  • Appointed by the Mexican Government to act as an auditor to supervise the actions of the conciliator and trustee of Compañía Mexicana de Aviación and its subsidiaries.
  • Advised Turbo Limited in the processing of its bankruptcy proceedings under Mexican law, seeking to restructure its debts, as well as to obtain the signing of a creditors’ agreement.
  • Represents and advises TGC Ingeniería, in its own insolvency proceeding.
  • Appointed by the Federal Institute of Bankruptcy Specialists (IFECOM) of the bankruptcy estate of the company Presta-melo, which is a financial institution regulated by the National Banking and Securities Commission (CNBV).
  • Advised and acted as conciliator of Perforadora Oro Negro bankruptcy. This bankruptcy proceeding is one of the most important insolvency proceedings in Mexico.

Litigation, Arbitration & Mediation

  • Defended the rights and interests of the estate of a private client in a nullity action regarding the sale and purchase of land in Baja California Sur more than fifty years ago with a value of more than 25 million pesos.
  • Represented Investigación Farmacéutica S.A. de C.V. on legal actions to recover the possession of a property located in the city of Cuautla, Morelos.
  • Represented a private client in a summary collection action, securing a final ruling which ordered the defendant to pay the amount claimed plus ordinary and default interests accrued.
  • Represents Crowley Technical Management, Inc./ Marine Management Services, Inc. in the judicial proceedings for the enforcement of the award in Mexico, and other related procedures.
  • Represented Exportadora de Sal, S.A. de C.V. in a proceeding for the annulment of the award or the rejection of its enforcement.
  • Advised Japan Tobacco International in a series of disputes brought by and against a former distributor in Mexico. We also represent the Client in the proceedings for the enforcement and recognition of an arbitral award obtained issued in France, under the rules of the ICC.
  • Represented Exportadora de Sal in a series of multimillion disputes regarding the termination of certain contracts for the sale and distribution of salt brine and sea salt.
  • Advised Getman Corporation in a dispute brought by a former distributor in Mexico, regarding the distribution of mining equipment.
  • Represented Tuxpan Port Terminal, in a real estate dispute regarding the boundary limits of its property in the Tuxpan Port Terminal in Veracruz.
  • Represented Aceros Camesa in a series of disputes brought against different debtors in order to collect million-dollar debts regarding the sale of steel products in Mexico.
