On July 23, 2025, the Federal Department of Industry and Trade approved the shortlists form the selection process for the National Competition Authority (“ANC”, according to its Spanish acronym), for the positions of President and four members of the Competition Tribunal, as well as the Secretary for Anticompetitive Conduct and the Secretary for Merger Control.
This measure represents a key formal step in the creation of the ANC, established by Antitrust Law No. 27,442.
It is worth noting that, pursuant to Law No. 27,442, once the ANC becomes operational, the 1-year period for the entry into force of the ex ante merger control regime will begin. Until that time, economic concentrations will continue to be reviewed ex post.
